SMITH COUNTY — An East Texas man charged with injury to a child was back in court Monday morning, after a baby suffered a skull fracture in his care back in December of 2010.
Saul Lino-Porcayo initially claimed his two month old daughter was injured when her sister jumped on her, but he was later taken into custody after admitting to authorities that he punched the baby in the face.
He says he was drunk and frustrated at the time.
The little girl was placed in foster care after her release from the hospital. Doctors say she would most likely suffer permanent brain damage.
Lino-Porcayo is scheduled to appear in court again Tuesday morning at 8:30 a.m. if a verdict is not reached Monday afternoon.
